In the area of collections, our firm has invested in both personnel and technology to maximize your Association’s opportunity for recovery of all delinquent assessments, including all legal fees and court costs. We have a dedicated team of collection administrators and attorneys handling all aspects of collections. We have also developed a customized software suite to provide the Board of Directors with automated monthly updates in order to track the collection matters placed with our firm. Collection matters are billed utilizing a combination of hourly charges and flat fees. The use of flat fees assures easy and accurate accounting of all legal fees and costs incurred by the Association during the first two phases of collection cases.
Stage One collection activities include our review of the tax records to assure that all owners of the delinquent unit are properly listed with our firm, our initial demand letter as required by the Fair Debt Collection Practices Act, all communications with the unit owner or the unit owner’s attorney, all communications with your Association and all other activities up to, but not including, the filing of a complaint. Stage Two collection activities begin with the filing of a complaint at the District Justice level. The global fee for this phase of the collection process includes all communications with the unit owner and the Association, preparation and filing of the complaint, preparation of all exhibits, travel to and attendance at the hearing and all other activities up to the receipt of the notice of judgment. Thereafter, we revert to our hourly rate for services associated with execution on the judgment. Our goal is to achieve a full recovery for our clients in the most efficient and cost effective manner.
In the area of transition from Declarant control to unit owner control, the attorneys at Marcus & Hoffman, P.C. have extensive experience in providing the Board of Directors with the information they need to successfully navigate this critical process. Our involvement in the transition process generally includes working directly with the Board of Directors or its duly designated transition committee and its professionals to complete the transition process in the most cost effective manner and to properly assure and protect the Association's rights with respect to any potential claims.
